Default Life Insurance death?

I have a life insurance claim on my dad for 50,000 dollars but im not sure what to do to get it or if i can get it. He hasnt been proclaimed dead but nobody has seen or heard from him in 5 years, and private investigators cant find him. He hasnt made any income since 2001. What do I need to start off by doing? The last known place he was, Was Colorado.

You should contact the life insurance company and ask what they will require before paying out.

this is a weird situation,your dad dissapeared 5 yrs ago?have you not talked to the insurance company about this?i doubt you will be able to claim anything until you at least know where your dad is,i asume you have to be claimed deceased before you can collect.take care

I would contact the police. Someone can be proclaimed legally dead after 7 years of being missing, which is fast approaching. I think in some areas it might be 5 years, but I would double-check with the police in the last area he lived (since that's most likely who would declare him dead). If private investigators can't find him, there's a pretty good chance that he's no longer living -- so you should definitely be prepared emotionally for anything that might come up.Good Luck!Griffin

Get a lawyer there is a process for having someone declared dead but I think it takes 7 years and has some very specific steps.If you know where in Colorado he last was go to that area talk to the police and see if during that time there were any "John Does". You may have to identify him from a postmortem photograph.

First step is to have him declared legally dead. You need the death certificate to file the claim. Most states, you have to be missing for 7 years. Then the BENEFICIARY gets paid - which may or may not be you.
