driver of the car was in the middle of the road and ended uo hitting ny spouse in the right front end. He was traveling at least 55-60 mph. my spouse's wrecker was totalled as well as the car. The officer who investigated the accident, found the other guy at fault. The insurance company was quick to settle with my spouse regarding the wrecker. He did sustain some injuries, none permanent or life threatening. The insurance company offered to pay all of his medical bills and 1000 bucks for pain and suffering. We do not feel this compensates him for the length of time he did hurt. We have a good attorney friend who has been telling us how to go about dealing with them. I just want to know how much he may really be entitled to. Your opinions.

How about all the time he could not work(calulate that), loss of business, pain and suffering, etc.$1000 sounds like pretty LOW-BALL to me...

20-30,000 sounds right to me plus medical bills and his vehicle!

Personal anguish and future complications resulting from the accident could settle out at 100K to 500K ($500,000). Shoot high and settle for more than a lousy 1K, my god he could have been killed or maimed for life.

For serious injuries, 1 to 2 times the actual damages is common. Lost wages should also be covered. If he didn't lose any work time, the P&S settlement would be rather moderate, though $1,000 sounds a bit too moderate if you catch my drift.Back in 1989, my then wife was hit by another car that initially left the scene but returned a few minutes later. His insurance company couldn't settle fast enough; there was a message on the answering machine when we got home. When we went to settle up, the agent let on that if we had walked in wearing cervical collars, he was authorized to give us $25,000 each in exchange for a release of liability. He did say that I could have had $25k even though I was not in the car at the time. He did offer us $1,500 for the "hassle and aggravation" of the whole situation which we gladly accepted.
