Default I bought a home brand new from builder 4 years ago & didnt buy title insurance. Can I buy it now? How?

Can someone take a home from me that no one else lived in? What should I do if they can?

I didn't know it was possible to buy without title insurance - unless you paid cash. Most lenders require it as a loan condition.

Find your closing documents and contact the company that closed this transaction. The builder should have had a clear title. Call the better business bureau! and NEVER EVER spend that much money without protection again. If you insure it so that it is covered if it burns down shouldn't you cover it so that you will always own it-no matter what? I know the answer you had no one to explain what it meant! So that means the builder protected his own interest, don't you think? Call a title company now and ask their attorney to look into this for you. You need a REAL ESTATE Attorney to help about now! Where was the REALTOR in this transaction-oh never mind I know the answer! Must have been missing! We know better! Good luck-I am sorry for your troubles just mad- that it didn't have to happen. The builder got to keep the money that woud have been shared with a REALTOR, you got the shaft.

This doesn't sound possible. You should research your purchase. I think you'll find that title insurance was purchased. No lender I know will loan money without it. The home can be taken by anyone showing legal documents showing rightful purchase. An attorney is the obvious recourse.

You can not buy title insurance in hindsight. I think it is highly unlikely, unless you paid cash, that you could purchase the home without title insurance, a lender would require it. If you do not have clear title, it is possible for someone to take the home, even if no one else has lived there. If someone is exercising a right on title to this property, you need a real estate attorney immediately.

Yes, you can buy title insurance after the sale has closed-it will just be somewhat more expensive than if you had purchased it at closing.The other answerer's have confused the fact that the mortgage company buys title insurance to cover the balance of THEIR investment. If you have an eighty percent loan, the mortgage lender has covered their investment of 80% of the purchase price, and your 20% is unprotected by their policy.Most of the time, the buyer is offerd the opportunity to purchase their own title insurance at close, at a substantially reduced cost, since all of the title research was alredy done in order to satisfy the requirements of the lender's policy. This is so highly reccomended that most attorneys will automatically include this on the HUD statement, and give you the option of excluding it, rather than the other way around. To get a policy now, you will have to incurr the cost of another title search by an attorney or title company, which will cost several hundred dollars, rather than the $100-$200 fee you would have paid at close.Incidentilly, If you don't recall instructing the attorney to remove the charge at close, chances are good that you did buy a policy. It is a one time charge, and there is no yearly fee or anything. Check your closing statement to see if two policies are on it. If you don't have a copy of the closing statement, check with the real estate brokerage that represented you, as they are supposed to hold records for 7 years. If you did not use a Realtor (for shame!) contact the closing attorney and ask them for a copy.If you find you do not have a policy, there are literally dozens of companies that will sell one to you. If you live in Georgia, I can recomend several to you if you contact me.The problem of title discrepancies in new homes is actually more prevailant than with older, established homes. The reason for this is that if the builder bought the land as a whole or by buying several lots, the title history of the land goes back, in some cases, several hundered years. There could have been many times that the property changed hands improperly. If the great great grand nephew of the farmer who originally owned the land your house is on finds a will or deed in the family bible (or whatever) that shows that the property was supposed to have passed to his side of the family rather than to another side, he can make a claim on the land. And, since the house is attached to the land...While scenarios like this are not particularly common, it does happen.
