I was in a car accident a few days ago. Basically, I was entering an intersection and failed to give way to a car travelling the opposite direction. Both cars have been written off.I was told that I was being charged with Driving without Due Care and I would be summonsed in 6 months.I have fully comprehensive car insurance with Allianz and I was wondering if they would cover all, some or none of the costs?

I got drunk and rammed the back of a pickup truck at a red light. I only had liability insurance, but they paid. I quit driving after that.

Just because you were ticketed doesn't mean you're at fault and this is what the majority of people who drive don't get.The only thing the ticket shows is you violated a vehicle code, nothing more, nothing less. It doesn't prove negligence and this is something entirely different than a vehicle code violation.Paying an insurance claim is based upon the negligence of the parties, not who received a ticket. Negligence laws nation wide acknowledge that RARELY IF EVER is1 person ever 100% at fault for an accident. The actions, or inaction, or both parties are looked at. So while you may have failed to drive withot using due care, what did the other driver do, or not do, to avoid the accident? How did the other driver contribute or not contibute to the accident? To answer your question....your insurance company will pay the damages of the other driver up to YOUR legal liability percentage. If they deem you 75% at fault, they will pay 75% of the damages. As for your car, depends on if you carry collision coverage or not, and it also depends on if your state is a Pure Comparative, less than 50% or greater than 50% negligent state.
